Last week (May 29, 2013) a Florida federal judge refused to release the maker of popular energy drink 5-Hour Energy from a proposed class action accusing it of deceiving consumers about the actual effects of the product, finding the case raised sufficient questions about the product's marketing. In 2012 the FDA began investigating deaths and hospitalizations tied to the energy drink. (See http://www.cbsnews.com/8301-204_162-57550247/fda-investigating-13-deaths-tied-to-5-hour-energy/). The case is Feiner v. Innovation Ventures LLC, filed in the Southern District of Florida.
